WAIVER

WAIVER OF LIABILITY - I understand, agree, and accept all risk of any and all injuries that I [participant and/or buyer] may suffer or incur as a result of my execution of this agreement and participation in any program and/or event offered by Dojo. I, on behalf of myself [participant and/or buyer] and anyone claiming by or through member and/or buyer, hereby holds harmless, releases and forever discharges Elite Martial Arts USA, LLC and/or Elite Martial Arts Hanover, LLC ("Dojo"), it’s officers, directors, employees, agents, representatives, instructors, and authorized reps from any liability, claim, loss...including loss of property, damage, personal injury, or expense incurred by member and/or buyer, and arising from member’s and/or buyer’s execution of this agreement, payment processing, participation in any program or class offered by Dojo.

MEDIA - I understand, agree, and consent to Dojo for myself and any [participant and/or buyer] listed within this agreement to unrestricted use of [participant and/or buyer] name, likeness, statements, photographs, motion picture for advertising, sale, marketing, or promotion, or any other purpose of trade; participant [and/or buyer] waives the right inspect or approve therewith.

BILLING AND PAYMENT - I knowingly and irrevocably authorize Dojo to charge electronically my bank account and/or credit card [or account selected] for any and all amounts due for me [participant and/or buyer], and anyone registering under my [participant and/or buyer], attendance and participation in the Event. All charges and/or fees are non-refundable and non-transferable unless indicated in writing by Dojo Management. Dojo actively passes credit card, debit card, checking, and/or savings account fees to participant. Any returned payment will be assessed a $25.00 fee. Any unsuccessful electronic transaction is subject to a $10.00 processing fee. Dojo is not responsible for any bank fees incurred by Customer. Dojo has the sole right to resubmit returned or declined items (plus applicable fees) without prior notice. Billing Inquiries: billing@elitekarateusa.com.

RULES & POLICIES - I agree to observe and follow all posted and provided rules, policies, and procedures of Dojo. Failure to comply may be grounds for suspension [of member and/or buyer] or immediate termination, neither of which shall entitle [member and/or buyer] to a refund or credit for any charges or fees paid or cancels any unpaid balance. I understand and agree presence and participation [buyer and/or member] are at sole risk of buyer and/or member. By signing this agreement, I represent, warrant, and insure that I have had the opportunity to observe programs offered at Dojo and that I [and buyer and/or member] am physically and mentally able to participate in Event offered by Dojo, and consent to engage in such contact as may be necessary by member’s and/or buyer’s participation Event, etc.

UNAVAILABILITY; FORCE MAJEURE - Dojo will use commercially reasonable efforts to hold the Event. However, under no circumstances will Business be held responsible for unavailability caused by circumstances beyond Business' reasonable control, including acts of God, acts of government, flood, fire, earthquakes, civil unrest, acts of terror, strikes or other labor problems nor can any reservation be cancelled, altered or amended once the Event has commenced on the basis of circumstances beyond Business' reasonable control.
